Yellow Ghana Seeks Injunction to Stop EC From Printing Ballot Papers

Samuel Apea-Danquah, leader of the Yellow Ghana movement, has filed for an interlocutory injunction to restrain the Electoral Commission (EC) from printing the notice of poll and ballot papers ahead of the December 7th general elections.

Apea-Danquah, who was disqualified from contesting the 2024 Presidential Elections along with Bernard Mornah of the People’s National Convention (PNC) and Janet Nabla of the People’s National Party (PNP), among others, argues that the EC’s decision was based on lies and violated his fundamental right to a hearing.

His lawyer, Martin Kpebu, in the application filed with the court, seeks a declaration that the EC’s decision to disqualify Apea-Danquah without providing specific grounds or an opportunity to be heard constitutes a breach of his constitutional rights.

The application further seeks a declaration that Apea-Danquah’s disqualification is illegal, citing several articles of the 1992 Constitution and the Public Elections Regulations, 2020 (C.I.127) as justification.

The injunction seeks to halt the printing process until the court can determine the legality of the EC’s decision to disqualify Apea-Danquah, potentially impacting the timeline for the upcoming elections.
